Terms & Conditions

By booking a session with us, you agree to the following Terms and Conditions.

Please read them carefully

1. Services Provided

Kristina Valdez ("Photographer") agrees to provide photography services to the Client as outlined in the booking. This includes the session time, post-production (editing), and final image delivery via a secure digital gallery.

2. Booking & Payment

  • A non-refundable deposit is required to secure your booking.

  • The remaining balance must be paid by the due date outlined on your invoice.

  • All invoices are required to be paid in full before the date of booking.

3. Cancellations & Rescheduling

  • In the unlikely event that Valdez Visions must cancel due to unforeseen circumstances, any deposits paid will be fully refunded.

  • All deposits are non-refundable. If you need to reschedule, your deposit can be applied to a new date, provided you give at least 5 days notice.

  • The Photographer reserves the right to reschedule due to illness, emergencies, or unsafe weather conditions.

4. Copyright & Usage

  • The photographer retains copyright to all images.

  • The Client is granted a personal-use license, allowing them to print and share their images for non-commercial use.

  • Images may be used for promotional purposes by Valdez Visions unless a written agreement states otherwise.

5. Model Release

  • Unless otherwise stated in writing, the Client grants permission for selected images to be used in the Photographer’s portfolio, website, or social media.

  • Clients can opt out of this by requesting in writing or ticking the opt-out section in their agreement.

6. Editing & Retouching

  • The Photographer’s creative style is trusted and respected. Basic editing and colour correction are included in the service.

  • Major retouching is not provided. This includes altering body shape, significant skin modification, or background changes. The Photographer’s editing approach focuses on enhancing natural tones and preserving authenticity.

7. Delivery of Images

  • Edited images will be delivered within 1–2 weeks of the shoot, unless otherwise communicated.

  • Images are delivered via Google Drive. RAW files are not provided.

8. Archiving

  • Final images are stored by the Photographer for up to 2 weeks after delivery. It is the Client’s responsibility to back up and safely store their files.

9. Liability

  • While all care is taken, in the unlikely event of camera failure, memory card corruption, or other unforeseen events, the Photographer’s liability is limited to a full refund of the paid session fee or a rescheduled shoot.

  • The Photographer is not responsible for wardrobe selections, weather conditions, late arrivals, or expressions that may affect the final images. Valdez Visions is also not liable for any injuries or damages that may occur during the photography session.

  • The Photographer is not liable for lost or damaged files once delivered and downloaded by the client.

10. Client Conduct

  • The Client agrees to behave respectfully during the session and provide a safe working environment for all involved.

  • Inappropriate, unsafe, or disrespectful behaviour may result in termination of the session with no refund issued.

11. Agreement Acknowledgement

By proceeding with a booking, the Client confirms they have read, understood, and agreed to these Terms & Conditions.

12. Governing Law

These Terms and Conditions are governed by the laws of Melbourne, Australia.
